Bill Pay Service

A. Using the Service
For an additional monthly fee, the Tri Counties Bank Bill Pay service allows you to schedule bill payments through the Tri Counties Bank Web Site or Voice Response System. You can schedule, at your option, for the payment of current, future and recurring bills from your Tri Counties Bank checking account(s). There is no limit to the number of payments that may be authorized (however, additional transaction fees will apply, see Section B, below).

You may pay almost any merchant or individual with the following restrictions: 1) The merchant must be located in the United States; 2) Payments may not be remitted to tax authorities or government and collection agencies; 3) Payments may not be remitted to securities brokerages such as Ameritrade for stock purchases or trade taxing authorities and 4) No Court directed payments are permitted (e.g., alimony, child support, or other legal debts).

By furnishing us with the names of payees/merchants, you authorize us to follow the payment instructions to these payee/merchants that you provide us through Tri Counties Bank Bill Pay.

The date the payment is to be sent is called the "send date". When we receive a payment instruction (for the current or a future date), we will transfer funds to the payee on your behalf from the funds in your Bill Pay Account on the send date.

Tri Counties Bank Online Bill Pay will process Payments on the business day (generally Monday through Friday, except holidays) you designate the bill to be processed, provided the payment request is received prior to the cut-off time of 1:00 PM PST/PDT. Bill requests received after the cut off time, or at any time on a non-business day will be processed on the next business day. Tri Counties Bank reserves its right to change the cut-off time without notice. Please contact us if you are concerned about same day payment processing.

For payments directed to third parties, such as credit card companies, other lenders, etc., you are responsible to determine and allow sufficient time for the payee to receive the payment. Some payees will receive your payment through automated electronic credits ("ACH"), while others will receive a paper draft ("Draft"), which is similar to a check. Your Bill Pay Payee list will tell you whether a given payee will be receiving its payment through the ACH or by Draft.
FOR RECURRING PAYMENT REQUESTS, IF YOU DESIGNATE A PROCESSING DATE OF THE 28th THROUGH THE 31ST OF A MONTH, PROCESSING WILL BE INITIATED ON THE LAST CALENDAR DAY OF THE MONTH. Otherwise, recurring payment requests will be processed on the dates you have designated, unless such date falls on a non-business day resulting in your payment being processed on the next business day.

We recommend that all payments and transfers be scheduled at least (8) eight business days before their actual due date, not the late date to insure timely receipt. So long as you properly follow the procedures described herein, if Tri Counties Bank BillPay fails to deliver a payment on the scheduled payment date, Tri Counties Bank Bill Pay will bear the responsibility for late charges due to such failure (up to $50.00 maximum). In any other event, including, but not limited to, choosing a payment date less than (8) eight days prior to the actual due date, the risk of incurring and the responsibility for paying any and all charges or penalties shall be borne by you.

Tri Counties Bank Bill Pay will use its best efforts to process all your payments properly. However, Tri Counties Bank Bill Pay shall incur no liability if it is unable to complete any payments initiated by you through Tri Counties Bank Bill Pay services because of the existence of any one or more of the following circumstances:
1. Your account does not contain sufficient funds to complete the transaction or the transaction would exceed the credit limit of your overdraft protection account.
2. The Tri Counties Bank Bill Pay processing center is not working properly and you know or have been advised by the service about the malfunction before you execute the transaction.
3. You have not provided Tri Counties Bank Bill Pay with the correct names or account information for the persons or entities to whom you wish to direct payment.
4. Other circumstances beyond the Tri Counties Bank Bill Pay's control such as, but not limited to, fire, flood, or interference from an outside force that would prevent the proper execution of the transaction so long as Tri Counties Bank Bill Pay has taken reasonable precautions to avoid those circumstances.

You have the right to stop or change any scheduled payment. However, you must cancel the payment not later than 3 PM (Pacific Time), on the Send Date, by using the DELETE function on the Tri Counties Bank Online Services "pending Payment" screen.

B. Bill Pay Service Fees for Businesses
The fee for Tri Counties Bank Bill Pay services for businesses is $5.95 per month for up to ten (10) bill payments to anyone you wish to pay in the U.S.
Beginning with the 11th bill payment, the additional fee per bill payment is $.43. (Forty-three cents).
The monthly fee is billed in advance and is effective upon enrollment. The monthly fee will be charged to your payment account (see Section IV.B. below), whether or not bill payments are submitted.
Additional Charges for Customer requested Services and Other Items. These charges will only be assessed if you request one or more of the services listed here. There will be NO Charge for any item if needed to correct a Tri Counties Bank error.

Payments returned due to customer error.................................$ 5.00
Tri Counties Bank reserves the right to charge you for research time involving payments no longer available in your screen history, which is typically the past 12 months. You will be informed of any such charges before they are incurred.

These charges are in addition to the fees and service charges specified in the Fee Schedule for your applicable checking, savings, and overdraft protection account agreements (for example, uncollected or overdraft charges on your checking account).

If the payment account has insufficient funds to cover fees, the Bank will deduct the fee from any other account maintained with Tri Counties Bank . If the fee cannot be paid, we may cancel your Online Bill Pay service. After cancellation, your Bill Pay service may be reinstated by contacting Tri Counties Bank Customer Service once sufficient funds are available in your payment account to cover the bill payment fees and any other pending transfers or debits.
