TERMS AND CONDITIONS FOR USE OF CANVAS CREDIT UNION eBILLPAY PLUS SERVICE

The following is an agreement between you and Canvas Credit Union ("Canvas") regarding the use of Canvas's Internet Bill Payment Service ("Service"). In this Agreement, the terms like "you" and "your" mean the Canvas member who enrolls in the service; the terms "we," "us," and "our" mean Canvas Credit Union.
1) Acknowledgment of Agreement. You acknowledge electronic receipt of the Terms and Conditions Agreement ("Agreement") associated with Canvas Credit Union's Internet Bill Payment Service and agree that you have read and will abide by this Agreement. You agree that we do not need to provide you with an additional paper (non-electronic) copy of this Agreement unless you specifically request a copy. Further, you understand that you may print a copy of this Agreement by using your browser's print command and a printer.
2) Enrollment in Service. We reserve the right to refuse enrollment in the Service to any member who does not meet the Service criteria established by us and/or any third party we contract with to provide the Service. Included in these criteria is a requirement that subscribers to this service must live within the United States, its possessions and territories.
3) Service Fees. You will not be charged a monthly fee for the Service as long as three (3) electronic bill payments are sent each month. If three (3) payments are not sent during the month, a fee of $3.95 will be charged on the last business day of the month regardless of whether the Service was used during the billing cycle. Fees for other transactions or optional services (e.g., insufficient funds or Stop Payment requests) may apply as specified in our Rate & Fee Schedule. You are responsible for any telephone or internet access fees that are assessed by your utility or internet service provider.
4) Payees. In this Agreement, a "Payee" is a vendor, person, or entity to whom you wish a payment to be directed. You may add a new Payee by selecting the "Payee" tab in the Service and entering the Payee's information. A Payee may be any vendor, person, or entity within the United States (including territories and APOs/AEOs), but we reserve the right to refuse to add a Payee for any reason. We are not responsible for any payments that cannot be made due to incomplete, inaccurate, or outdated Payee information.
5) Payments. You may schedule single payments or recurring payments to Payees you have added to the Service:
a) Single Payments. A single payment will be processed on the business day (generally Monday through Friday, except certain holidays) that you designate as the payment's processing date, provided the payment is submitted prior to the daily cut-off time on that date. The daily cut-off time is 2 pm Mountain Time. A single payment submitted after the cut-off time on the designated process date will be processed on the next business day. If you designate a non-business day (generally weekends and certain holidays) as the payment's processing date, the payment will be processed on the first business day following the designated processing date.
b) Recurring Payments. When a recurring payment is processed, it is automatically rescheduled by the system. Based upon your selected frequency settings for the payment, a processing date is calculated for the next occurrence of the payment. If your frequency settings for the recurring payment specify the 29th, 30th, or 31st as a particular day of the month for processing and that day does not exist in the month of the calculated processing date, then the last calendar day of that month is used as the calculated processing date. If the calculated processing date is a non-business date (generally weekends and certain holidays), it is adjusted based upon the following rules:
- If the recurring payment's "Pay Before" option is selected, the processing date for the new occurrence of the payment is adjusted to the first business date prior to the calculated processing date.
- If the recurring payment's "Pay After" option is selected, the processing date for the new occurrence of the payment is adjusted to the first business date after the calculated processing date.

6) Payment Arrival Dates. The system will calculate the Estimated Arrival Date of your payment. This is only an estimate, so please allow ample time for your payments to reach your Payees.
7) Cancelling a Payment. A bill payment can be changed or cancelled any time prior to the cutoff time on the scheduled processing date.
8) Availability of Funds. We may, at our option, pay a scheduled payment which exceeds the balance in your checking account by transferring the amount of the resulting overdraft from your available line-of-credit or savings account, subject to the terms of your Deposit Account Contract and other agreements you have with us. Per Federal regulations, pre-authorized telephone, Internet or automatic transfers from prime savings to cover checking account overdrafts cannot exceed six (6) in number per calendar month.
9) Liability. We are not liable if the Service is unable to complete a payment for any of the following reasons:
a. Your Account does not contain sufficient funds to complete the payment or transfer, or the transfer would exceed the credit limit of your established line-of-credit account, if applicable (see the "Availability of Funds" section of this Agreement for more details);
b. The Bill Payment processing center is not working properly and you know or have been advised by the Service about the malfunction before you execute the transaction;
c. The Payee mishandles or delays a payment sent by the Service;
d. You have not provided the Service with the correct names, phone numbers, or account information for those persons or entities to whom you wish to direct payment;
e. You failed to promptly notify us after you learn that you have not received credit from a Payee for a bill payment; or
f. Circumstances beyond the Service's control (such as, but not limited to, fire, flood, or interference from an outside force) that prevent the proper execution of the transaction and the Service has taken reasonable precautions to avoid those circumstances.
10) Authorized Access. You agree not to give or make available your Internet Banking Account Number and Access Code to any unauthorized individuals. You are responsible for all Bill Payments you, and your Internet Bill Payment authorized user, authorize using the Service. If you permit other persons to use the Service or your Canvas Credit Union Account Number and Access Code (even though you have agreed not to disclose this information), you are responsible for all transactions they authorize. If you believe that your Canvas Credit Union Account Number and Access Code has been lost, stolen or compromised, or that someone may attempt to use the Service without your consent or has transferred money from your account by accessing your account without your permission, you must notify us immediately by calling us during business hours.
11) Errors. The provisions about error resolution in the Electronic Funds Transfers Disclosures that were part of your Deposit Account Contract apply in full to all payments you schedule through the Service.
12) Amendment. The terms of this Agreement, applicable fees and service charges may be altered or amend-ed by the Service from time to time. In such an event, the Service shall send notice to you at your address of record or by secure electronic message via the Canvas Credit Union Internet Home Banking ser-vice. Any use of the services after the service sends you a notice of change will constitute your agreement to such change(s). Further, the Service, may, from time to time, revise or update the programs, services, and/or related material, which may render all such prior versions obsolete. Consequently, the Service re-serves the right to terminate this Agreement as to all such prior versions of the Internet Bill Payment pro-grams, services, and/or related material and limit access to the Service's more recent revisions and updates.
13) Termination or Discontinuation of Service. In the event you wish to discontinue the Service, you must contact Canvas Credit Union within ten (10) days prior to the actual service discontinuation date. You must request the service discontinuation by written correspondence sent via the mail. Written notice must be signed and sent to:

Canvas Credit Union may terminate Service to any individual at any time with cause, and without advance notice. Neither termination nor discontinuation shall affect your liability or obligation under this Agreement.
14) Assignment. You may not assign this Agreement to any other party. The Service may assign this Agreement to any future, directly or indirectly, affiliated company. The Service may also assign or delegate certain of its rights and responsibilities under this Agreement to independent contractors or other third-party service providers.
15) No Waiver. The Service shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by the Service. No delay or omission on the part of the Service in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies. A waiver on any one occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions.
16) Severability. The invalidity or unenforceability of any provision of this Agreement shall in no way affect the validity or enforceability of the remainder of this Agreement or any of its provisions.
17) Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflicts of law provisions.
